(a) A copy of the Client’s Hong Kong Identity Card;
(b) A copy of the Vehicle Registration Document;
(c) A copy of the Vehicle Licence;
(d) A certificate confirming no outstanding fixed penalty or non-payment or litigation;
(e) An Auction Authorization;
(f) An authorization for redemption; and
(g) Deposit (cashier order or cash).
Only upon our Company’s receipt of the deposit (as per our Schedule of Auction Fees), our Company could be regarded as accepting the Client’s appointment for auction.
2. The Client shall set his reserve price and such reserve price cannot be retrieved once it has been fixed. Further, once the reserve
price is fixed and the bidding price do exceed the reserve price, the Client shall sell the Vehicle and shall raise no objection or
make any other request.
3. The Client shall confirm and undertake the truthfulness of the descriptions to the Vehicle for auction. Our Company shall not be
responsible for any misrepresentations made by the Client and the Client shall indemnify our Company for all losses and
damages arising from any misrepresentations made by the Client.
The Vehicle for auction provided by the Client shall be free from any terms and conditions under any charge or security but the Client shall have his/her sole rights to offer the Vehicle for auction.
4. If the event that the Vehicle is subject to existing mortgage from a finance company, the Client can authorize our Company for
redemption in relation to the Vehicle Registration Document (“Redemption Authorization Service”). For such serve, our Company
shall charge the Client service charges and administrative fees (for the particulars please refer to our Schedule of Auction Fees or
make enquires with our staffs for further information). In the event that the selling price in the auction is not sufficient to pay the
redemption money, the Client shall pay for the difference by way of cashier order. Our Redemption Authorization Service is
subject to our previous approval.
5. Our Company is at liberty to reject any application for Redemption Authorization Service. In the event there is any delay being
caused or arising from in the approved application, our Company is still at sole discretion to terminate any such application. The
Client shall raise no claim against our Company but should apply for redemption by his/her own.
6. In the situation the Client makes arrangement for redemption himself/herself, once the Vehicle is sold in an auction, the Client
shall within 2 days from the date of the auction produce our Company the original Vehicle Registration Document and also the
original receipts confirming redemption payment being made. In any event, our Company shall be authorized responsible to
arrange the title transfer of the Vehicle.
7. In the event that the Client withdraws the Vehicle from auction less than 14 days before the date of auction, our Company shall
remain being entitled to charge the Client administrative fees for the Vehicle.
8. The Vehicle shall be auctioned on an “as-is” basis.
9. Our Company shall have our own discretion for the following:-
(a) Whether to offer the Vehicle for auction;
(b) Whether the Vehicle is suitable for auction, and if so, the time, place and conditions for the auction;
(c) The description of the Vehicle in the catalogue for an auction;
(d) Whether any expert opinion is required.
10. Our Company shall release the balance of selling price (after deduction of all expenses in the auction payable to our Company)
to the Client within 5 working days after the completion.
11. When the vehicle is sold in an auction, the Client shall within 2 days provide our Company the original Vehicle Registration
Document. If the Vehicle cannot be sold in an auction, our Company will then inform the Client but the Client shall remain
responsible to pay for our Company the auction fees.
12. In the event that the Vehicle cannot be sold in an auction, the Client shall within 3 days from the date of auction collect the
Vehicle from our Company. If the Client do fail to collect the Vehicle as aforesaid, the Client shall be responsible to pay for all
our Company’s charges for transpiration, storage and/or insurance.
13. If a buyer do fail to comply with the terms and conditions of an auction or fail to complete the transaction by the date of
completion, without prejudice the rights of the Client for further losses and/or damages, the Client shall have the rights to forfeit
all deposits paid but in such event the Client shall pay for our Company the auction fees. In such circumstances, the Client shall
be entitled to offer the Vehicle for sale either by private treaty or public auction. The Client shall be entitled to require the buyer to
reimburse all his/her expenses for selling the Vehicle and pay for the difference between the auction price and the subsequent
selling price (if any).
14. Our Company do have the absolute right to adjust our auction fees and the Client and the buyer shall raise no objection thereto.
15. In all circumstances our Company shall not be responsible for any losses including any loss arising from theft, loss and/or
damages to the Vehicle. The Client shall understand his/her own risks and do accept subject to such risks authorize our
Company for auction.
