Consignment - Terms & Conditions
1. The Client shall at least 14 days before the date of auction provide the following documents:-
(a) A copy of the Vehicle Registration Document;
(b) A copy of the Vehicle Licence;
(c) A certificate confirming no outstanding fixed penalty or non-payment or litigation; (d) An Auction Authorization; (e) The Client’s certificate and/or confirmation to his/her identity; and (f) Deposit (cashier order or cash)
Only upon our Company’s receipt of the deposit (as per our Schedule of Auction Fees), our Company could be regarded as
accepting the Client’s appointment for auction.
2. The Client shall set his reserve price and such reserve price cannot be retrieved once it has been fixed. Further, once the
reserve price is fixed and the bidding price do exceed the reserve price, the Client shall sell the Vehicle and shall raise no
objection or make any other request.
3. The Client shall confirm and undertake the truthfulness of the descriptions to the Vehicle for auction. Our Company shall
not be responsible for any misrepresentations made by the Client and the Client shall indemnify our Company for all
losses and damages arising from any misrepresentations made by the Client.
4. When the vehicle is sold in an auction, our Company shall release the balance by cashier order of the selling price (after
deduction of all expenses in the auction payable to our Company) within 3 days to the Client. The Client shall submit the
original Vehicle Registration Document and Bank payment receipt at the same time. In any event, our Company shall be
authorized responsible to arrange the title transfer of the Vehicle.
5. In the event that the Client withdraws the Vehicle from auction less than 14 days before the date of auction, our Company
shall remain being entitled to charge the Client administrative fees for the Vehicle.
6. The Vehicle shall be auctioned on an “as-is” basis.
7. Our Company shall have our own discretion for the following:-
(a) whether to offer the Vehicle for auction;
(b) whether the Vehicle is suitable for auction, and if so, the time, place and conditions for the auction;
(c) the description of the Vehicle in the catalogue for an auction;
(d) whether any expert opinion is required.
8. When the vehicle is sold in an auction, the Client shall within 2 days provide our Company the original Vehicle
Registration Document. If the Vehicle cannot be sold in an auction, our Company will then inform the Client but the Client
shall remain responsible to pay for our Company the auction fees.
9. In the event that the Vehicle cannot be sold in an auction, the Client shall within 3 days from the date of auction collect
the Vehicle from our Company. If the Client do fail to collect the Vehicle as aforesaid, the Client shall be responsible to
pay for all our Company’s charges for transpiration, storage and/or insurance.
10. If a buyer do fail to comply with the terms and conditions of an auction or fail to complete the transaction by the date of
completion, without prejudice the rights of the Client for further losses and/or damages, the Client shall have the rights to
forfeit all deposits paid but in such event the Client shall pay for our Company the auction fees. In such circumstances,
the Client shall be entitled to offer the Vehicle for sale either by private treaty or public auction. The Client shall be
entitled to require the buyer to reimburse all his/her expenses for selling the Vehicle and pay for the difference between
the auction price and the subsequent selling price (if any).
11. Our Company do have the absolute right to adjust our auction fees and the Client and the buyer shall raise no objection
thereto.
12. In all circumstances our Company shall not be responsible for any losses including any loss arising from theft, loss
and/or damages to the Vehicle. The Client shall understand his/her own risks and do accept subject to such risks
authorize our Company for auction.
Consignment Procedures
1. 於截止日前遞交所有文件、繳付按金及領取拍賣編號
Submit all documents and deposit before due date.
2. 於開放日前兩天將拍賣車輛駛至觀塘碼頭廣場9樓
Place the auction vehicle to 9/F Kwun Tong Harbour Plaza 2 days before open day.
3. 將於拍賣日後第一天將會收到通知是否成功拍賣及成交價 1 day after auction, the seller will be notified whether the vehicle is successfully bid.
4. 成功拍賣/Successful
(4.1) 拍賣後3天內本公司會到該財務以本票贖會車輛登記文件正本及後備車匙
Within 3 days after the auction, our Company will redeem the original registration documents and spare keys by cashier order.
Within 3 days after the auction, seller can pick up their vehicle at 9/F Kwun Tong Harbour Plaza. (Note: Late charge for storage will be HK$200/day)
Conditions of Sale
1. The Vendor of the Vehicle is selling as the legal owner of the Vehicle and therefore the concurrence of any other persons
in such sale shall not be required and no Purchaser shall raise any objection or requisitions in respect thereof.
2. The vehicle is sold according to the Conditions of Sale provided herein and further subject to the Special Conditions of
Sale as stated in the Sales Contract.
3. Subject to a reserved price, the highest approved bidder being so allowed by the Auctioneer shall be the Purchaser
thereof. The Auctioneer shall have the right to refuse any bid. If any dispute shall arise as to the highest bidder the
Vehicle shall be put up again at the last undisputed bid. No bid shall be withdrawn or be less in advance of the last
previous bid than the sum to be fixed by the Auctioneer at the time of or during the sale. The Auctioneer reserves the final
right of adjudication on any bid.
4. The Vendor do not undertake to accept the highest bidder and reserve the right to withdraw the sale of the Vehicle at any
time before the same is actually sold without declaring the reserved price and giving prior notice to parties concerned.
5. The Purchaser shall immediately on fall of the hammer pay to the Vendor deposit of ten per cent (10%) of the purchase
price (“Deposit”) in cash or by Banker’s Order and sign the Sales Contract to complete the purchase according to the
Conditions of Sale provided herein and Special Conditions of Sale as stated in the Sales Contract. HK$2,000 auction fee
plus 2% of the hammer price or HK$1,000 for the auction commission (whichever is higher) will be charged for each car.
6. The Purchaser shall pay the balance of the purchase money by banker’s Order and complete the purchase on or before
the Completion Date by 4:30p.m ., unless otherwise stated, at the office of the Vendor which is situated at Room 415,
4/F, Nan Fung Commercial Centre, 19 Lam Lok Street, Kowloon Bay, Hong Kong. All monies in respect of the sale of the
vehicle should make payable to the Vendor.
7. The vehicle is sold at the present condition and on an as-is basis. The Vendor shall not be responsible for any defects and
faults, either hidden or so found, in the Vehicle and the Purchaser shall not reject to purchase the Vehicle because of any
defects and faults and if it is not fit for any purpose upon signing of the Sales Contract.
8. The Vendor shall not be called upon or be bound to produce or procure the production of any documents, agreements,
writings whatsoever in respect of the Vehicle nor to give any information in relation thereto and no objection or requisition
shall be made in respect thereof.
9. Title of the vehicle shall be deemed to have been accepted by the Purchaser on the signing of the Sales Contract. No
requisitions and objections of whatsoever nature in respect of the title or otherwise shall be raised by the Purchaser.
10. Without prejudice to any other remedy available to the Vendor, if the Purchaser shall fail to comply with any of the terms
and conditions contained herein or if the Purchaser shall fail to complete the purchase on or before the Completion Date,
the deposit paid by the Purchaser shall be wholly forfeited to the Vendor who shall be at liberty to resell the Vehicle with
or without notice to the Purchaser either by public auction or private contract. Any deficiency in price which may happen
on and all expenses attending such re-sale shall be borne by the Purchaser and shall be recoverable by the Vendor as
and for liquidated damages and any increase in price realized by any such resale shall belong to the Vendor. The
Vendor shall be entitled to demand payment of interest over the balance of purchase money due at the rate of 2per cent
per month calculated from the date on which the same ought to have been paid to the actual date of payment together
with all the legal costs of the Vendor and other expenses which may be incurred in demanding recovering or attempting
to recover the same on an indemnity basis.
11. If the Vendor shall for any cause (other than the default of the Purchaser) fail to complete the sale and purchase
hereunder in accordance with the terms hereof then the deposit and all other monies (if any) paid hereunder shall be
returned to the Purchaser without interest and the Purchaser shall have no right to claim against the Vendor for any
compensation or damage.
12. All the process of the auction will be recorded for any disputes occurred in the future.
13. Time shall in all respect be of the essence of these Conditions.
14. The Vendor does not make or give and neither the Auctioneer nor any person in the employment of the Vendor has any
authority to make or give any representation or warranty whatsoever in relation to the vehicle.
15. Notwithstanding any provisions herein, the Vendor excludes liability and gives no express or implied warranty as to the
state, condition, composition, installation, function of any parts or systems of the Vehicle or the legality of any
accessories installed thereon. The Purchaser hereby fully aware that the Vehicle may consist of any such defects or
illegal accessories and shall have no claim or right for compensation against the Vendor in respect of such matter.
16. The Purchaser shall be bound to complete the purchase notwithstanding any refraining orders, injunctions or restrictions
are found imposed on the Vehicle after the signing of the Sales Contract. The Purchaser should fully aware the risks
they have to undertake and shall have no claim or right for compensation against the Vendor. The Purchaser is advised
to make his own enquiries beforehand to determine whether and to what extent, the Vehicle may be affected by any
such restrictions.
17. Transfer of the title of the Vehicle must be completed and delivery of the Vehicle must be taken within 3 working days
from the date of the signing of the Sales Contract unless otherwise stated by the Vendor. If the Purchaser shall fail to
take delivery of the vehicle within the specified period, the Purchaser shall be fully responsible for all costs and
expenses additionally incurred.
18. In the event of any proceedings, actions, claims or demands whatsoever by any person for any loss, damage or injury
caused to any person whomever or any property whatsoever against the Vendor relating to the Vehicle as stated in the
duly signed Sales Contract after the date of the Purchaser’s receipt of the Vehicle Registration Document or the delivery
of the Vehicle, the Purchaser shall be fully responsible for and shall indemnify the Vendor fully and effectually from any
loss or damages arising from such proceedings, actions, claims or demands including legal costs on an indemnity basis.
19. The terms and provisions hereof shall be severable and if any term or provision hereof shall be held to any extent to be
invalid or unenforceable the remainder of the terms and provisions excluding such term or provision shall be valid and forceable.
20. It is hereby declared that (if the context permits or requires) words importing the singular number shall include the plural
number and vice versa and words importing the masculine gender shall include the feminine gender and the neuter gender.
21. The Conditions stated herein and the Sales Contract shall be constructed and governed by the law of the Hong Kong
Special Administrative Region of the People’s Republic of China.
22. Should there be any inconsistency between the English and Chinese versions of these Conditions, the former shall prevail.
Auction Procedures
1. 於開放日到觀塘碼頭廣場9樓參觀及檢查車輛。
Visit and inspect auction vehicles at 9/F Kwun Tong Harbour Plaza during open days.
2. 於拍賣日到觀塘鴻圖道駿業街48號三樓(東港海鮮酒家)進行拍賣，如成功拍賣後即場簽署買賣合約。
Auction will be held at 3/F No. 48 Hung To Road (East Harbour Seafood Restaurant). Sales and purchase agreement will be
signed after the auction vehicle successfully bid.
3. 繳付成交價10%訂金、過戶費及拍賣行政費用。
10% deposit, transfer fee and handling charges must be paid after contract signed.
4. 拍賣後3天內到九龍灣臨樂街19號南豐商業中心4樓415室以本票或現金繳付餘數及有關過戶文件。
All related documents and balance by cashier order or cash must be paid at Rm 415 Nan Fung Commercial Centre, 19 Lam Lok
St., Kowloon Bay, within 3 days after auction.
5. 繳交餘數5天內到觀塘碼頭廣場9樓取車及文件 (取車前請電 9863 5108 預約)
註 : 逾期取車需支付存倉費日租HK$200.00
